 米国ミズーリ州「大陪審」は11月24日、今年8月9日に「丸腰の18歳青年」Michael Brownを射殺した白人警官Darren Wilsonを、不起訴処分とする決定を下したが、この不当処分に抗議する運動はニューヨークを始めとする全米約170都市に拡大し、現在も、大通りを埋め尽くすデモ行進の外、’Black Friday’ と呼ばれるクリスマス・セールで賑わう都市中心部・盛り場での ’die in’ 抗議の形などで展開されている様だ。

 ミズーリ「大陪審」が、当の白人警官を「不起訴」処分にしたということに、先ず「違和感」を覚えるのは、筆者ばかりではなかろう。このケースの場合、「有罪・無罪」はさて措いても、少なくとも「裁判」があって、どのような経緯で黒人青年が射殺されるに至ったのか、具体的に明らかにされるべきだった。
 裁きの場で、「人種差別」実態が明々白々と暴露されることを恐れたのだろうか? 捜査対象者を起訴するかどうかを判断する、12人の市民から成る大陪審の構成は、白人が9人、黒人が3人だったという。
 抗議運動は、現地ファーガソンでの商店焼き打ちや略奪という不法行為も見られたが、圧倒的多数の参加者は整然とした、説得力を伴ったものだった。

 米国オバマ大統領は今度の「大陪審」評決について、不満な表情を浮かべ乍らも、決定には従うべきだとしたが、Holder司法長官は、連邦段階でMichael Brown「射殺」が法に則ったものかどうか、「再審議」を行う方針を表明した。

 米国内外のマス・メディアは、概ね、ミズーリ「大陪審」評決について批判的であるが、大手・米『ワシントン・ポスト』紙や仏『ル・モンド』紙が揃って、「何故こうした評決に至ったか?」という形の、ともすれば「評決・弁護」的とも受け取られかねない長文記事を、評決直後に掲載しているのは不思議だ。

 その内容は、被害者Michael Brownの「無抵抗」行動を目撃したという人物たちが、証言途中で「姿を消した」とか、Michael が手を「上に上げず、ズボンのポケットに突っ込んでいた」という証言者が居るという様な、被害者にとって不利な「事実」を紹介しているものだ。その上で、警官Darren Wilsonは「正当防衛」でMichaelを射殺したという「評決」を紹介している。
 確かに大柄のMichael が白人警官を「威嚇した」ことはあった様である。—<本ブログ8月23日付参照されたし>
 しかし乍ら、武装警官が「丸腰」被害者を「7発もの銃弾」で射殺したという「厳然たる」事実を軽く見る姿勢は、メディアとしての良心を疑わせるものだ。

 驚いたことに、同様の黒人射殺事件が先週11月22日、オハイオ州Clevelandで起こっていた。12歳の黒人系少年Tamir Riceが 公園で ‘toy gun’ を持って遊んでいたところ、白人警官から二発の弾丸を受け、翌日死亡したという*事件である。
 この事実については、筆者が偶々Michael Brown の事件を調べていたところ、英国 ’Mail Online’ 及び ’The Independent’ 紙が、米国で新たに起こった事件としてかなり詳細に報じているのを見て知った次第である。

 米国での痛ましい事件の結末について、英仏のメディアは辛辣な批判報道を続けている。例えば、仏*『リベラシオン』紙(11月28日付)は、’Racisme, Le rève perdu’ 「人種差別:失われた夢」という見出しで、週末版の特集記事を掲載している。副題は「ファーガソン:米国の悪魔の目覚め」として、次の様に続ける。

 一方、同じく仏紙*『ヌーヴェル・オプセルヴァトウール』(11月27日付)は、

ETATS-UNIS. "La police a longtemps été l'instrument de répression des Noirs" —米国:「警察は長らく黒人弾圧の道具だった」

として、警察制度の米・仏での違いを文化的背景に基づいて歴史学者が説明している。例えば、米国では「白人優位」の仕組みを維持する為に、特に南部では白人至上主義・秘密結社「クー・クラックス・クラン」メンバー出身者が警官になっていることが屢々あるという指摘は驚くべきものだ。
 
 11月28日付の『ニューヨーク・タイムズ』紙は、

'Protesters United Against Ferguson Decision, but Challenged in Building Movement' ー「抗議する人々はファーガソン評決に反対して団結しているが、運動を造り上げる点で挑戦を受けている」

と題する長文記事の中で、セントルイス・オークランド・シカゴ・ニューヨークなどでの「ファーガソン大陪審評決・抗議」デモの模様を詳しく紹介しながら、これ迄起こった幾つもの白人警官による「黒人射殺」事件と関連づけ、関係者が如何に「差別主義・廃止」の運動を長期的に構築して行くかという課題に苦しみ乍ら取り組んでいることを伝えている。   (2014.11.30)

1. 12月2日付『ニューヨーク・タイムズ』紙の記事 'A Week Later, Protests Continue Over Ferguson Decisions'に依ると、12月1日、St.Louis は固より、New England、Texas、California、など全米で MIchael Brown 射殺事件についての「大陪審」・白人警官「不起訴」評決に対する抗議運動が、大学・学校構内、駅、裁判所、市役所、連邦官庁などの前で展開され、Michael の遺体が「4時間半」に渉って路上に放置されていたことを象徴する「4分半」の'die-in' も各地で行われたという。『ハーバード』大 'Law School' では、約300人の学生たちが、'No justice, no peace' 「正義無き所に平和無し」と唱和したという。また首都ワシントンでは、抗議デモが大通りを閉鎖し、司法省の前で座り込みが行われたということだ。 (2014.12.02)

12月1日 Fergusonでの 'die-in'

2. この12月3日、ニューヨーク・Staten Island「大審院」が、タバコの「不法販売」の罪で無抵抗の43歳黒人男性Eric Garner を取り押さえようとして、首を絞めて死に至らしめた白人警官Daniel Pantaleo(29歳)に対して、またもや「不起訴」処分とした件は、先の「ファーガソン」事件に引き続いて全米に激しい衝撃を巻き起こしている。この事件の経過はヴィデオに撮られ、TVなどで放映されており、白人警官4人が大柄とは言え,黒人一人を強引に抑え掛かる状況は、黒人・白人を問わず、多くの人々の激怒を招いており、現在ニューヨーク・マンハッタンなどで数千人規模の抗議デモが展開されている。 (2014.12.04)

3. 12月2日、アリゾナ州 Phoenix でも、ドラッグ犯罪歴を持つとされる34歳の黒人Rumain Brisbonが、「女友達と子供の前で」丸腰で居たところ、白人警官に2発の銃弾を受けて死亡するという事件が発生した。現地でも、間もなく抗議デモが始まったというが、これ迄の事件と相俟って、現在「全米でデモが市街地を埋め尽くしている」ー『ニューヨーク・タイムズ』紙ー状態だということだ。
 今日5日の 'BBC World' TV・'Hard Talk' に出演した米・人権問題専門家の話に依ると、米国では「28時間に一人」の割合で黒人が白人警官の銃弾を受けているという。 (2014.12.05)

Après les meurtres de deux jeunes Noirs par les polices municipales de Ferguson et Cleveland, "l'Obs" s'interroge : quelles tensions entre ces deux populations ? L'historien François Durpaire répond.

Tamir Rice avait 12 ans lorsqu'il a été tué par la police de Cleveland (Ohio) samedi 22 novembre, après avoir joué avec un pistolet à billes. Deux jours plus tard, lundi 24 novembre, le verdict du grand jury de l'affaire Ferguson tombe : c'est un non lieu. Darren Wilson, le policier incriminé dans le meurtre le 9 août dernier de Michael Brown, un jeune-homme de 18 ans, ne sera pas poursuivi en justice.
Outre leur jeunesse, les deux victimes ont un point commun : ils sont tous deux Noirs. Deux drames qui mettent en exergue la sinueuse question raciale dans la police américaine. Pourquoi un tel rapport entre les forces de l'ordre et les Noirs américains ? Quelles différences culturelles entre les polices française et américaine ? L'historien François Durpaire, spécialiste de la diversité culturelle aux Etats-Unis, éclaire "L'Obs". Interview.
Pourquoi la relation entre la police et les Noirs américains est-elle si complexe aux Etats-Unis?
- Historiquement, il y a aux Etats-Unis un imaginaire particulier de la police. Cette dernière, exclusivement blanche, a longtemps été l'instrument de la répression des Noirs, dans un système de domination et de suprématie blanche. Dans les municipalités du sud notamment, les policiers étaient souvent membres du Ku Kux Klan.

Cette influence est encore présente aujourd'hui, comme le montre l'enquête menée par le Pew Research Center du 14 au 17 août, juste après la mort de Michael Brown. Celle-ci a évalué l’écart entre les Blancs et les Noirs sur l’appréciation de la police municipale. Les résultats sont éloquents : 65 % des personnes noires interrogées estimaient que la police avait fait un usage excessif de la force dans le cas Ferguson, contre 33% seulement pour les Blancs.
Pourquoi cette tension est-elle particulièrement aiguë avec la police de Ferguson ? 

- Dans sa composition raciale, celle-ci ressemble à la police des années 1960 : 56 policiers sur 57 sont Blancs. Ce sont eux qui, municipalement, tiennent les rennes, alors que démographiquement, les Noirs sont bien plus nombreux.
Les codes de la police américaine sont-ils différents de ceux de la police française ?
- Il est important de comprendre qu'il n'y a pas une mais des polices américaines. Difficile donc de faire une comparaison avec la France. Nous avons tendance à penser que les forces de l'ordre dégainent plus vite outre-Atlantique. Or aux Etats-Unis, il y a d'une part les polices municipales, d'une autre la police fédérale : le FBI.
Dans le cas de Ferguson, c’est de la police municipale dont on parle, alors qu'au niveau fédéral, deux enquêtes sont en cours. L'une concerne la question du droit civique, à savoir : y a-t-il eu du racisme dans cette affaire ? La seconde se concentre directement sur l'action de la police de Ferguson.
Cela signifie-t-il que, d'une municipalité à l'autre, le rapport entre les forces de l'ordres et les communautés diffère ? 

- Absolument, et certaines sont plus en avance que d'autres dans la réflexion sur la relation entre la police et son environnement. Prenons celle de Ferguson : elle apparaît bien plus rétrograde que la police française, puisqu'elle n'intègre pas les minorités. En revanche, la police de Détroit mène une politique complètement différente en matière d'abolition des préjugés, de formation de ses agents, etc. On pourrait même se dire qu'elle a des choses à nous enseigner.

Cleveland police have released video footage showing the moment 12-year-old Tamir Rice was shot dead by a rookie officer who mistook his BB gun for a real weapon.
The boy was shot by Timothy Loehmann, 26, on Saturday after a 911 caller reported seeing a juvenile waving around a gun - but did not know whether or not it was real. Newly-released audio showed that the 911 dispatcher did not pass on this concern to the responding officers.
At a press conference on Wednesday, authorities released the 911 call, police dispatch calls and a grainy video showing the moment the officers arrived and shot the boy.
The footage shows Rice - who the officers thought was about 20 - reaching for his waistband instead of responding to police requests to raise his hands, police said. They fatally shot him just two seconds after pulling up in their cruiser, the footage shows.

As millions of American shoppers headed to stores in search of post-Thanksgiving bargains, scores of demonstrators interrupted Black Friday shopping in St Louis as part of a retail boycott over the death of unarmed teen Michael Brown in Ferguson.
The boycott is the latest strategy by protesters to draw attention to issues snapped into focus by Brown’s death: racism, economic inequality and police brutality in America. Monday’s grand jury decision not to indict Darren Wilson for killing Brown on 9 August led to days of violent protests in a number of American cities.
Beginning on Thanksgiving night, dozens of activists turned up at major retailers around the St Louis area with protest signs. They chanted “Hands up, don’t shoot!” as shoppers whizzed past in search of heavily-discounted TVs and vacuum cleaners.
The demonstrations, staged at a local Target and multiple Walmart stores, were brief and peaceful. As of mid-morning, there were no reports of arrests related to the protests. In at least one instance, protesters were ordered by police to leave, and they did so peacefully, Reuters reported. More protests were expected throughout the day on Friday.
The boycott, which used the hashtag #BlackOutBlackFriday on Twitter, is an extension of the Black Lives Matter campaign, meant to empower black voices by demonstrating their purchasing power.
The movement was explained in a video produced by Ryan Coogler, director of Fruitvale Station, a film recounting the story of a young black man shot dead by a white transport policeman in Oakland, California.
“This season, show your worth,” the video exhorts its viewers. “Help stop police brutality by speaking a language everyone understands. Don’t shop November 28th.”
Meanwhile, millions of Americans were reveling in Black Friday spoils, queueing for sales on Thursday evening or arriving in time to catch the early-bird specials on Friday morning.
The National Retail Federation, an industry group, estimated that 140 million Americans would shop in-store and online over the Thanksgiving weekend. The group predicted seasonal shopping sales would rise by 4.1% from the same months last year to $616.9bn.
The commercial creep of Black Friday saw stores opening as early Thursday evening. As many as 25.6 million US people were expected to shop on Thanksgiving day this year, the federation said. Macy’s said more than 15,000 people were lined up outside its flagship New York City store when it opened its doors at 6pm on Thanksgiving.
Wilson: “Yes, that’s not an area where you can take anything really. Like I said, it is a hostile environment.”

My 20-year-old grandson, Will, the most gentle and respectful young man you would ever want to meet, posted this on his Facebook page:
“Regarding the recent events in Ferguson: I’ve always wanted to believe my country was free. But today’s grand jury decision tells me this cannot be the case. No country that refuses to hold the police, those so-called ‘defenders of the law,’ accountable for its unjust brutality — and yes, it is often very brutal — can be free. When the grand jury declined to charge Darren Wilson for his actions, what kind of a message does that send? . . . It doesn’t seem fair that police can commit brutal acts against innocent people and get away with it.”
It’s not, Will. Not today. Not in your great-grandmother’s day when that Mississippi grand jury let that white farmer get away with murder. Not ever.
